Terms of Service
These Terms of Service (“Terms”) govern your use of Artificial Thrift (“we,” “us,” or “our”) at artificialthrift.com and related services. By creating an account, submitting an item, or accepting a payout offer, you agree to these Terms. If you do not agree, do not use our services.
1. Who we are and what we do
Artificial Thriftoperates a consignment-style resale platform. You submit clothing and related items (“Items”) with photos and details; we may provide an automated payout estimate, list Items for sale on third-party marketplaces (including eBay and, when available, others such as Depop or Poshmark), coordinate sale logistics, and pay you a portion of the sale proceeds if your Item sells.
We are not purchasing your Items upfront unless we expressly agree otherwise in writing. Until an Item sells, you retain ownership. By accepting an offer and submitting an Item, you appoint us as your agent to photograph, describe, price, list, and sell the Item on your behalf subject to these Terms.
2. Eligibility
- You must be at least 18 years old and able to enter a binding contract.
- You must be located in the United States and able to ship Items domestically when requested.
- You must provide accurate contact information and respond to sale and shipping requests promptly.
- You may not use our services for Items you do not own or lack authority to consign.
3. Submitting items and accepting offers
When you submit an Item, you represent that all information (brand, condition, size, category, photos, and description) is accurate and complete. Our AI-assisted pricing tools and payout estimates are based on comparable marketplace data and are estimates only, not appraisals or guarantees of sale price.
If you accept a displayed payout estimate and complete submission, you enter a consignment agreement for that Item. We list the Item at a sale price based on our market analysis (typically near the estimated sale price shown at acceptance). Marketplace buyers pay the item price plus applicable shipping and taxes as shown on the listing platform — shipping is paid by the buyer, not deducted from your payout.
We may accept, reject, or hold Items for manual review (for example, low-confidence pricing, luxury goods, authenticity concerns, or policy violations). Rejection does not create any payment obligation.
4. Payouts
If your Item sells, you receive 70% of the final item sale price (not including shipping paid by the buyer). The payout estimate shown at acceptance is based on our estimated list/sale price and the same percentage — your actual payout depends on the final sale price. Estimates are not guarantees of sale price or payout amount.
Payouts may be reduced, withheld, or recovered for misrepresentation, fraud, failure to ship, chargebacks, returns, or policy violations as described below.
Timing. Payouts are issued after the sale completes and required post-sale conditions are met, which may include: buyer payment clearing, your shipment of the Item with a label we provide, delivery confirmation, and expiration of applicable buyer return windows on the selling platform (currently up to 14 days on our eBay listings unless otherwise stated). We may withhold or delay payout during return, dispute, or investigation periods.
Adjustments and chargebacks. If an Item is returned, not as described, counterfeit, damaged due to your misrepresentation, or subject to payment reversal, we may reduce, withhold, or recover payout amounts and relist, dispose of, or return the Item at our discretion. You authorize us to offset amounts you owe against future payouts.
Payout methods and timing may change; we will use reasonable efforts to notify you of material changes. You are responsible for any taxes on amounts you receive.
5. Your responsibilities as consignor
- Authenticity. Items must be genuine and accurately described. No counterfeits, replicas, or materially misleading listings.
- Shipping. When an Item sells, you must ship within 48 hours (or the deadline we communicate) using the prepaid shipping label or instructions we provide. You must not cancel, refuse to ship, or substitute another item after accepting an offer and after a sale.
- Condition. Ship Items clean and in the condition represented. Include any disclosed flaws.
- Availability. Do not sell, donate, or remove an Item elsewhere after submission while it is listed or sold through us.
- Compliance. Items must comply with marketplace rules and applicable law (no stolen goods, hazardous materials, recalled products, etc.).
Failure to meet these obligations may result in payout forfeiture, account suspension, and liability for our costs (including return shipping, refunds to buyers, and platform fees).
6. How we list and sell
We list Items under our seller accounts on third-party marketplaces unless otherwise agreed. Listings may use your photos, our edits, AI-generated titles/descriptions, and pricing strategies we choose. Buyers purchase from us (or our designated marketplace account); marketplace shipping is paid by buyers as calculated or stated on the listing, not by you.
We control listing price, discounts, relisting, delisting, and marketplace choice. We may remove or reject Items that harm buyer trust, violate platform policies, or are unlikely to sell profitably.
7. Returns and buyer disputes
Marketplace buyers may have return rights under our listing policies (for example, 14-day domestic returns on eBay, with return shipping paid by the buyer for change-of-mind returns unless otherwise required by law or platform policy). Returned Items are shipped to us, not back to you by default. We handle buyer refunds and may relist returned Items.
If a return or dispute is caused by your inaccurate description, wrong item shipped, or authenticity issue, you bear the economic loss as described in Section 4.
8. Prohibited items
You may not submit:
- Counterfeit, replica, or unauthorized goods
- Stolen property or Items you cannot legally sell
- Items with material undisclosed damage, stains, odors, or alterations
- Hazardous, regulated, or recalled products
- Non-clothing categories unless we explicitly allow them
- Any Item that violates marketplace or applicable law
9. Photos, content, and license
You grant Artificial Thrift a non-exclusive, worldwide, royalty-free license to use, store, reproduce, modify, and display photos, descriptions, and other content you submit for listing, marketing, authentication, quality review, and operating the service. You represent that you have all rights needed to grant this license.
10. Accounts and communications
You are responsible for your account credentials and activity under your account. We may send transactional emails and texts (sale notices, shipping labels, payout updates) to the contact information you provide. See our Privacy Policy for how we handle personal data.
11. Fees
There is no fee to receive an estimate or submit an Item unless we state otherwise. We earn compensation from the difference between marketplace sale proceeds (after platform fees, shipping-related costs we incur, returns, and chargebacks) and your payout. We do not guarantee that every Item will be listed or sell.
12. Termination and withdrawal
You may stop using the service at any time. You may request withdrawal of an Item before it sells, subject to our approval and any costs already incurred. After an Item is listed or sold, withdrawal may not be permitted.
We may suspend or terminate access, reject Items, or delist at any time for violation of these Terms, risk, or business reasons.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI PRICING AND IDENTIFICATION TOOLS MAY BE INACCURATE. WE DO NOT GUARANTEE THAT ANY ITEM WILL SELL, SELL WITHIN A TIMEframe, OR SELL AT A PARTICULAR PRICE.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTIFICIAL THRIFT AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE PAYOUT AMOUNTS WE PAID YOU IN THE THREE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.
15. Indemnification
You agree to defend, indemnify, and hold harmless Artificial Thriftand its operators from claims, losses, and expenses (including reasonable attorneys' fees) arising from: (a) Items you submit; (b) your breach of these Terms; (c) misrepresentation or infringement; (d) buyer or platform disputes caused by your actions; or (e) your failure to ship or ship the correct Item.
16. Disputes and governing law
These Terms are governed by the laws of the United States and the State in which Artificial Thrift is principally operated, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in that State, and you consent to personal jurisdiction there, except where prohibited by law.
Before filing a claim, you agree to contact us at support@artificialthrift.com and attempt to resolve the dispute informally for at least 30 days.
17. Changes
We may update these Terms from time to time. We will post the revised Terms with an updated “Last updated” date. Material changes may also be communicated by email or in-app notice. Continued use after changes become effective constitutes acceptance.
